Terms and Conditions

  1. Introduction

These Terms and Conditions ("Terms") constitute a legally binding agreement between you (the "Customer") and The Hamper, a company registered in Hong Kong. By accessing our website www.thehamper.com.hk and/or placing an order, you agree to comply with and be bound by these Terms.

 

  1. Orders and Acceptance

2.1. Order Placement: Customers must provide accurate and complete information when placing an order, including but not limited to name, contact details, delivery address, and payment information.

2.2. Order Confirmation: Receipt of an order confirmation via email signifies acknowledgment of your order but does not constitute acceptance. We reserve the right to accept or decline any order at our sole discretion.

2.3. Acceptance of Orders: Orders are considered accepted once they have been processed and dispatched. We reserve the right to cancel any order due to reasons such as stock unavailability, errors in product or pricing information, or fraudulent activity.

 

  1. Pricing and Payment

3.1. Pricing: All prices are quoted in Hong Kong Dollars (HKD). Prices are subject to change without notice.

3.2. Payment Methods: Payment must be made at the time of order placement. We accept the following forms of payment: [Credit Card, Paypal, AlipayHK].

3.3. Payment Processing: By providing your payment information, you authorize us to charge the specified amount to your selected payment method.

 

  1. Delivery

4.1. Delivery Area: We offer free delivery services within most areas in Hong Kong.

4.2. Delivery Schedule: While we aim to deliver on the specified date, delivery times are not guaranteed and may be affected by factors beyond our control, such as inclement weather or traffic conditions.

4.3. Delivery Charges: Additional charges may apply for special delivery requests.

4.4. Delivery Policy: The sender will be responsible to ensure that the recipient is present at the address during the day of the delivery. If by any chance that our courier service could not locate the recipient after several attempts, of; if the delivery details provided is incorrect, The Hamper and our collaborative delivery partner will not be liable for the failed delivery.

We do everything we can to ensure our hampers are delivered. If for any reason we made a mistake and deliveries don’t turn up, (i.e. if your hamper have not arrived on their intended delivery date), please contact our customer service at cs@thehamper.com.hk to inform us. We will send you a replacement on our next available delivery date.

4.5. Delivery re-scheduled: In the event a delivery is re-scheduled or re-routed upon the request of the recipient or by the sender, a re-delivery fee will be applied depending on the delivery location. Re-delivery or re-routing is subject to the next available time slot.

4.6. Adverse weather conditions: During adverse weather conditions (including heavy rain and flood), our delivery partners may not be able to deliver orders on time. This is outside of our control, and we cannot accept responsibility for the late delivery of the order. Therefore, in the event of adverse weather conditions, we aren’t able to refund or offer re-delivery of affected orders.

 

  1. Damage

Our hampers are wrapped or arranged carefully to ensure they arrive as good as when they left us. However, on a small number of occasions (and for reasons beyond our control) they may get damaged in transit. Should this occur to a level that you deem unacceptable, please contact our customer care at cs@thehamper.com.hk to inform us immediately so that we can arrange a replacement at our next available delivery date. Please note that you will need to email us a photo of the damaged hamper within 24 hours of receipt in order to be eligible for a replacement.

 

  1. Cancellation and Refunds

6.1. Order Cancellation: Customers may cancel their order without charge up to 48 hours before the intended delivery day. Cancellations made after this period may incur a fee. Same-day and on-demand orders are processed immediately and cannot be cancelled.

6.2. Refund Policy: Refund requests are subject to our discretion and must be made within 2 days of delivery. Approved refunds will be processed within 10 business days, some banks can take up to 15-30 days.

 

  1. Product Descriptions and Substitutions

7.1. Product Accuracy: We strive to ensure that all product descriptions and images are accurate. However, we do not guarantee that descriptions or images are free of errors. The images of products on our website are for illustrative purposes only. Although we make every effort to display colors accurately, we cannot guarantee that your device’s display of the colors accurately reflects the actual color of the products. In the event of any errors in the product description or any part of the site, we reserve the right to correct such errors without any prior notice and to deny or cancel orders placed based on erroneous information, irrespective of whether the order has been confirmed.

7.2. Stock Availability: Products are subject to availability. We reserve the right to substitute items of equal or greater value in the event of stock shortages, no additional charge will be applied. Any substitutes will be carefully selected to ensure they closely match or exceed the quality and purpose of the original items.

 

  1. Limitation of Liability

In no case shall The Hamper, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost saving, loss of data, replacement costs, or any similar damages, whether based in contract, tort(including negligence), strict liability or otherwise, arising from your use of any of the service or any product procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content(or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

To the maximum extent permitted by law, The Hamper shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from the use of our products or services.

 

  1. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

 

  1. Amendments to Terms

We reserve the right to modify these Terms at any time without prior notice. Changes will be effective upon posting on our website. Continued use of our services constitutes acceptance of the modified Terms.

The Hamper reserves the right to alter or terminate the Promotion and amend the terms and conditions at any time without notice. In case of disputes, the decision of The Hamper and respective merchants shall be final.

If there is any inconsistency or conflict between the English and the Chinese versions, the English version shall prevail.
